TRADE AND TREATY. 336
April 19th, 1918.
Paraphrase. Sir J. Jordan, (Peking),
D. 7.0 p.m. April 19th, 1918. R. 8.0 a.m. April 20th, 1918. No.344.
(R).
Trade-marka.
On recommendation of Joint Committee of China Association at Shanghai and British Chamber of Commerce supported by Chambers at Canton Tientsin and Hankow I suggested that in new bill a clause be inserted providing that registration under part "B" may be made retrospective from date of first proved user which should be ascertained and supported as to length of use and class of goods by Statutory Declaration registrar being entitled to restrict to a particular market user of mark so registered.
That Japanese will withdraw objection to British principle of priority of user does not seem very likely and when legisla- tion is eventually introduced into China safeguard for British interests appears to be afforded by above procedure.
